Welcome to PhotoWipy. By downloading, installing, or using our mobile application, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our app.

1. Acceptance of Terms

By accessing and using PhotoWipy ("the App"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this App.

2. Description of Service

PhotoWipy is a photo storage cleaner and gallery cleaner mobile application designed to help users organize and manage their device photo libraries through an intuitive swipe-based interface. The App allows users to:

• Review photos from their device camera roll
• Delete unwanted photos through swipe gestures (swipe left to delete, swipe right to keep)
• Organize photos by month and year
• Track storage space recovered in real-time
• View storage insights for each monthly album

3. Subscription Plans and Pricing

3.1 Available Plans

PhotoWipy offers the following subscription plans:

• Monthly Subscription: $4.99 USD per month
• Yearly Subscription: $19.99 USD per year (equivalent to $1.67/month)

3.2 Subscription Features

All subscription plans include:

• Unlimited photo cleanup with swipe gestures
• Monthly and yearly photo organization
• Real-time storage insights
• View of today's new photos separately
• Priority customer support
• Ad-free experience

3.3 Payment and Billing

Subscriptions are billed through your Apple App Store or Google Play Store account. Payment will be charged to your account at confirmation of purchase.

You can manage and cancel your subscription at any time through your device settings:

• iOS: Settings → [Your Name] → Subscriptions → PhotoWipy
• Android: Play Store → Menu → Subscriptions → PhotoWipy

3.6 Cancellation Policy

You may cancel your subscription at any time. Upon cancellation:

• Your subscription will remain active until the end of the current billing period
• You will not be charged for subsequent periods
• Premium features will be disabled at the end of the billing period
• No partial refunds will be provided for unused time

3.7 Price Changes

We reserve the right to modify subscription prices with at least 30 days' notice. Price changes will not affect active subscriptions until renewal.

4. User Responsibilities

4.1 Account and Device

You are responsible for:

• Maintaining the security of your device
• All activities that occur under your use of the App
• Ensuring your device meets the minimum requirements to run the App
• Maintaining an active subscription for premium features

4.2 Photo Management

You acknowledge that:

• You are solely responsible for backing up your photos
• Deleted photos cannot be recovered by PhotoWipy
• You should review photos carefully before deleting
• PhotoWipy is not liable for any accidentally deleted photos

5. License and Usage Rights

5.1 License Grant

Subject to your compliance with these Terms and an active subscription, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use.

5.2 Restrictions

You may not:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Rent, lease, lend, sell, or redistribute the App
• Use the App for any illegal or unauthorized purpose
• Remove any copyright or proprietary notices
• Share your subscription with others

6. Refund Policy

6.1 Apple App Store Refunds

For iOS users, all refund requests must be made through Apple. We do not have the ability to process refunds for App Store purchases. To request a refund:

• Sign in with your Apple ID
• Find your PhotoWipy subscription and request a refund

6.2 Google Play Store Refunds

For Android users, refund requests must be made through Google Play. Within 48 hours of purchase, you may request a refund directly through the Play Store. After 48 hours, contact Google Play support.

6.3 Our Refund Assistance

While we cannot directly process refunds, if you're unsatisfied with PhotoWipy, contact us at anujitha.apps@gmail.com and we'll help guide you through the refund process with Apple or Google.

7. Privacy and Data

Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices regarding your data.

Key privacy points:

• Your photos are processed locally on your device
• We do not upload, store, or transmit your photos to our servers
• We may collect anonymous usage statistics and subscription information
• All data collection complies with applicable privacy laws

8. Disclaimers and Limitation of Liability

8.1 "As Is" Basis

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

8.2 No Warranty

We do not warrant that:

• The App will meet your requirements
• The App will be uninterrupted, timely, secure, or error-free
• The results obtained from using the App will be accurate or reliable
• Any errors in the App will be corrected
• Deleted photos can be recovered

8.3 Limitation of Liability

9. Indemnification

You agree to indemnify, defend, and hold harmless PhotoWipy and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the App, including any deleted photos or subscription disputes.

10. Modifications to the App and Terms

10.1 App Modifications

We reserve the right to modify, suspend, or discontinue the App or any features at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the App.

10.2 Terms Modifications

We may revise these Terms from time to time. The most current version will always be posted on our website. By continuing to use the App or maintain an active subscription after revisions become effective, you agree to be bound by the revised Terms.

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination:

• Your right to use the App will immediately cease
• Your subscription will be cancelled (no refund for unused time)
• You must delete the App from your device

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

13. Dispute Resolution

13.1 Informal Resolution

Before filing any formal claim, you agree to contact us at anujitha.apps@gmail.com to attempt to resolve the dispute informally.

13.2 Arbitration

Any disputes arising out of or relating to these Terms, the App, or subscriptions shall be resolved through binding arbitration rather than in court, except you may assert claims in small claims court if they qualify.

15. Severability

These Terms, along with our Privacy Policy, constitute the entire agreement between you and PhotoWipy regarding the use of the App and subscriptions, and supersede all prior and contemporaneous agreements.

By using PhotoWipy and subscribing to our services ($4.99/month or $19.99/year), you acknowledge that you have read these Terms of Service and agree to be bound by them.
